After the repeat elections of the Moldovan President on December 7, 2009, the single candidate nominated by a group of legislators from the Alliance for European Integration (AIE) — Marian Lupu, PDM leader, did not receive 61 votes; this means that the President of the Republic of Moldova was not elected. As a result, the circumstances for dissolution of the Parliament of the XVIIIth Legislature and for holding early parliamentary elections have arisen. General information on elections
At its meeting on November 27, the Parliament adopted a decision on setting December 7, 2009 as date for the repeat elections of President. Besides, a Special Commission for the repeat election of the President of the Republic of Moldova was established. By December 3, when the deadline for nominating candidates for President expired, only one candidate — Marian Lupu, leader of PDM, on behalf of a group of legislators from the Alliance for European Integration (AEI) was registered.
On December 7, Parliament held a special sitting to elect the President of the Republic of Moldova. The quorum was met since all legislators, including the PCRM faction registered for the sitting. Later, the PCRM faction boycotted the voting procedure, as it did in the sitting of November 10, and the only registered candidate for President, the PDM leader Marian Lupu got 53 votes cast by legislators of the parliamentary majority (AIE).
According to legislation and constitutional norms, even if after repeat elections the Moldovan president is not elected, the acting President shall dissolve the Parliament and set a date for new parliamentary elections. Besides, under some additions to the Law #1234/22.09.2000 on the procedure for electing the President of the Republic of Moldova, the next dissolution of the Parliament could take place only after a year since the last dissolution. Moldovan Parliament elected on April 2009 was dissolved on June 16 of the same year.
So far, the Constitutional Court has not officially ruled on the interpretation and application of those regulations.

According to the legislation, if only one candidate run in the first round of elections and does not get 3/5’s of the legislators elected; repeat elections shall be conducted within 30 days after the last ordinary elections that failed to elect the President of the Republic of Moldova. The repeat elections are conducted under same procedural conditions as the ordinary elections.
CEC has validated the July 29, 2009 elections to the Parliament of the Republic of Moldova; voter turnout was 58.77%. On August 4, CEC approved the protocol totalising election results for the 18th Parliament and the Report on election results, and submitted them to the Constitutional Court than has confirmed the legality of elections and the election results.
On August 8 four out of five parties that crossed the 5%-electoral threshold — PLDM, PL, PDM and AMN — have constituted the Ruling Coalition “Alliance for European Integration”. In the early parliamentary elections of July 29, these parties won together 53 parliamentary seats out of 101. PCRM has already declared that is ready to go into opposition.

Following the April 5 elections, four contestants — Party of Communists of the Republic of Moldova (49.48%, 60 seats), Liberal Party (13.13%, 15 seats), Liberal-Democratic Party of Moldova (13.43%, 15 seats) and “Moldova Noastra (Our Moldova)” Alliance (9.77%, 11 seats) — passed the electoral threshold and will be represented in the new Moldovan Parliament.
