The candidate to the post of Governor of Gagauzia must be a citizen of Moldova who turned 35 years and speaks Gagauz. The same person is re-eligible for the post of Governor of Gagauzia for two consecutive mandates.
Law # 344-XIII from 23.12.1994 on Special Legal Status of Gagauzia (Gagauz-Yeri) establishes that the Governor of Gagauzia is elected through a universal, equal, direct, secret and free vote for a 4-year mandate on alternative basis. Under Regulation of Gagauzia and local laws in the field, the election of the Governor of Gagauzia is invalid if less than half of voters participate in the first round of scrutiny and less than one third of electors attend the runoff vote. The candidate who garner more than half of the votes of electors who participated in elections is winner.
If none of candidates is elected in the first round of the scrutiny, the central electoral commission of Gagauzia establishes the date of the runoff vote, which will take place after two weeks, with the participation of the first two candidates. The candidate who garnered most of votes is declared winner of the runoff vote but if one of candidates withdraws, the candidate who gains more than half of the votes of electors who participated in elections is declared winner.
The elections of Governor of Gagauzia are set under a decision by the People’s Assembly of Gagauzia not later than three months after competences of the incumbent Governor expire or within three months after the post becomes vacant (in case of dismissal, impossibility to exercise the functions or death). The date of elections is established with maximum 60 days before.
